Note: For the purpose of
subsection 49(2) of the Transport Safety Investigation Act
2003 (TSI Act) I declare that any On-Board Recording (OBR)
relating to a matter the ATSB decided not to investigate, as
identified in this publication, is not to be treated as an OBR on
and after the date of publication of this Weekly Summary.
Section 48 of the Act contains a definition for an OBR. A
Cockpit Voice Recorder normally will meet the requirements of the
definition to be considered an OBR.
Part 6 Division 1 of the TSI Act provides for certain
confidentiality protections which must be applied to OBRs. Where an
OBR is declared not to be an OBR, please note that almost identical
protections apply to Cockpit Voice Recordings under Part IIIB of the
Civil Aviation Act 1988.
